welcome to e.shockley llc. by hiring me, booking a service, or purchasing from my site, you agree to the following terms. these exist to protect both of us — but mostly to protect me from the nightmare scenarios i’ve already lived through in this industry.

payments & deposits

  • a minimum 50% non-refundable deposit is required before i start any custom design or strategy project.

  • the remaining balance is due before final files, websites, or deliverables are released. no exceptions.

  • all payments are non-refundable, period. (you’re paying for my time, expertise, and reserved schedule — not a guaranteed outcome.)

  • payment plans may be available on a case-by-case basis, but missed payments will pause or terminate the project.

no refunds. ever.

  • i do not offer refunds for any services or digital products. once you’ve paid, the spot, time, or file is yours.

  • change your mind mid-project? you’re still responsible for the full balance.

  • digital downloads, templates, or strategy guides are also non-refundable since they’re delivered instantly.

ghosting & suspension policy

  • if i don’t hear from you for 7 consecutive days (no feedback, no responses), your project will be suspended.

  • to reinstate a suspended project, you’ll be required to pay a reinstatement fee (minimum $100 or 10% of your total project cost, whichever is greater).

  • projects left inactive for 30+ days may be permanently closed without refund.

client conduct & right to refuse service

i reserve the right to refuse, pause, or terminate any project if:

  • you become disrespectful, abusive, or unprofessional.

  • you continuously ignore deadlines, requests, or approvals.

  • you try to sidestep agreements, payments, or scope of work.

  • if i fire you as a client, you are still responsible for all work completed to that point. no refunds.

file delivery & ownership

  • all design files, websites, and deliverables remain the property of e.shockley llc until final payment is made.

  • i am not obligated to release editable or source files (ai, psd, raw layouts, etc.) unless agreed upon in writing.

  • you will receive finalized, agreed-upon deliverables after full payment clears.

  • i reserve the right to withhold files under any circumstance (especially if invoices are unpaid, communication has stopped, or agreements are violated).

scope & revisions

  • all projects include a set number of revisions as outlined in your proposal/contract.

  • additional revisions, concepts, or changes outside the agreed scope will be billed separately.

  • scope creep = more money. don’t assume “just one more little thing” is included.

timeline & deadlines

  • i’ll provide a project timeline once work begins. timelines are dependent on you providing feedback, content, and approvals on schedule.

  • delays on your end = delays on delivery. i am not responsible for missed deadlines caused by client inaction.

  • rush projects may incur additional fees.**

portfolio rights

  • i reserve the right to showcase completed work in my portfolio, social media, and marketing materials, unless we have a signed NDA.

  • you do not have the right to resell or redistribute my designs unless explicitly agreed to in writing.

no guarantees

  • i design with strategy, but i cannot guarantee specific outcomes (sales, leads, engagement, traffic, etc.).

  • marketing and design are tools — results depend on your business, industry, and how you use the work i create.

liability

  • i am not liable for lost profits, business losses, or any damages caused by the use (or misuse) of my work.

  • once files are delivered and approved, you are responsible for their use and upkeep.

legal stuff

  • these terms are binding once you book, pay, or use my services.

  • i can update these terms & conditions at any time.

refunds + cancellations policy

  • ​no refunds. period. not for deposits, not for digital products, not for services in progress.

  • cancelling a project midway does not relieve you of the responsibility to pay for completed work.

  • payment plans must still be honored in full, even if you stop using the service.

I respect your privacy (and I also hate spam). Here’s everything you need to know about how I handle your info, no corporate jargon — just the facts.

what i collect

when you use my site, book a service, or buy something, i may collect:

  • basic info you give me: name, email, phone number, business details.

  • payment info: handled by secure third-party processors (wix payments, stripe, paypal, etc.). i never see or store your full card details.

  • technical info: ip address, browser type, pages visited, cookies. (because analytics don’t run on vibes.)

how i use it

i use your info to:

  • deliver the services you’ve paid for.

  • send invoices, confirmations, and project updates.

  • email you with resources, offers, or newsletters (opt out anytime).

  • keep my website running smoothly and securely.

sharing info

  • i don’t sell, rent, or trade your info — ever.

  • i only share it with trusted tools i use to run my business (payment processors, email marketing platforms, analytics, etc.).

  • if the law requires me to hand something over, i’ll comply.

cookies

yes, i use cookies — not the chocolate chip kind, the digital kind. they:

  • keep the site functional.

  • track analytics (google analytics, wix tools).

  • help with marketing/ads (meta pixel, etc.).

you can block or clear cookies in your browser if you want to. just know some site features may stop working.

your rights

depending on where you live (looking at you, gdpr + ccpa folks), you may have the right to:

  • access, correct, or delete your data.

  • restrict how i use it.

  • ask me what i’ve got on file about you.

data retention

  • i keep your info only as long as needed to deliver services, comply with legal obligations, or resolve disputes.

  • once it’s no longer needed, i securely delete it.

data security

  • i use secure platforms and processors to keep your info safe.

but — the internet is the internet. i can’t promise 100% security (no one can). by using my site, you accept that risk.

third-party links

  • if i link to another site (like a tool i recommend), i’m not responsible for their privacy practices. check their policies before handing over your info.
